discharges under
10 U.S.C. § 1553, as implemented in
SECNAVINST
5420.174D.
What is
the purpose of the Naval Discharge Review Board?
The purpose of the review conducted by
NDRB is to:
-
Determine whether the discharge was
granted in a proper manner, and,
-
Determine whether the discharge was
fair and equitable considering the regulations in effect at the time of
discharge.
Who may apply to
NDRB?
NDRB is designated to make final
determinations as to whether discharges of former members of the Navy and
Marine Corps were proper, just, and equitable under reasonable standards of
naval law and discipline and to make changes, if warranted.
Who reviews NDRB's decisions?
The decisions the Board are subject to review
by the Secretary of the Navy. The Board's
purpose is to make a determination whether a member's discharge was proper,
just, and equitable under reasonable standards of naval law and discipline
and to make changes or corrections, if appropriate.
Does
NDRB review all matters pertaining to discharges and separations?
No.
NDRB
is not permitted to review discharges that fall into one of the following
categories:
- Older than 15 years;
- Awarded as the result of a general
court-martial;
-
Involve physical or medical disability, or,
- Reenlistment (RE) codes.
For these requests, you must petition the
Board for the Correction of Naval Records (BCNR).
How do I submit an application to
the Naval Discharge Review Board?
1. Submit a
copy of your DD293, "Application for Review of Discharge or Dismissal from
the Armed Forces of the United States". For a copy of the form, access the
NDRB
website
and click on Request for Discharge DD293, or you may obtain a copy from most
military installations and regional Veteran Administrations. The form
is also available on the Department of Defense forms management website at
http://www.dtic.mil/whs/directives/infomgt/forms/forminfo/forminfopage63.html
2. The
form must be signed by the applicant. If the individual is deceased or
incompetent, any authorized persons, such as spouse, next of kin or legal
representative may sign the DD293.
3. This
application must be accompanied with a copy of the;

Discharge Certificate (DD214)
-
Certificate of Death, incompetence and
evidence of relationship, (if applicable)
Statements,
Affidavits, Depositions, Documents and information desired by Applicant
to be reviewed by the board.
4. Forward
